Her sister passed away in Broward county Florida. I was retained to initiate a probate proceeding in Broward county. Primary asset was decedent's homestead. Explained to client that this would be protected from the claims of unsecured creditors. There is a ACHA claim for $113,000, but because of the Order Determining Homestead Status of Real Property the unsecured creditor cannot place a lien on the property. The issue right now is that the condo was subject to a property insurance claim and whether the proceeds from this claim are subject to the claims of creditors.
